These Terms of Service (“Terms”) govern your use of the Loosy In The Sky app (the “App”), operated by PARSONS CO. LLC. By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use the App, and old enough to form a binding contract in your jurisdiction. If you make purchases, you represent that you are authorized to use the payment method provided.
2. Your Account
You are responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information and keep it up to date.
3. The Service
The App lets you discover the performer, view shows and live location, request bookings, send tips, and purchase merchandise. Features may change, and we may modify or discontinue parts of the App at any time.
4. Bookings & Payments
Bookings may require a deposit or payment processed through Stripe. Amounts, deposits, and any fees are shown before you confirm. Bookings are subject to the performer's availability and acceptance. Unless stated otherwise or required by law, deposits and completed payments are non-refundable.
5. Tips
Tips are voluntary payments to support the performer and are non-refundable once sent.
6. Merchandise
Merchandise is printed and shipped by a third-party provider (Prodigi). Prices, availability, and delivery times may vary. Provide an accurate shipping address; we are not responsible for delays or losses caused by incorrect address information. Returns or replacements for defective items are handled case by case — contact us at loosyapp@gmail.com.
7. Your Content
If you upload content (such as photos, videos, or messages), you keep ownership of it, but you grant us a non-exclusive, worldwide license to host, display, and use it to operate the App. You are responsible for content you upload and must have the rights to share it.
8. Acceptable Use
Do not use the App to break the law, infringe others' rights, harass anyone, upload harmful or unlawful content, attempt to disrupt or reverse-engineer the App, or misuse payment or booking features. We may suspend or terminate accounts that violate these Terms.
9. Intellectual Property
The App, its branding, and its content (excluding user content) are owned by PARSONS CO. LLC or its licensors and are protected by law. You may not copy, modify, or distribute them without permission.
10. Third-Party Services
The App relies on third-party services including Google Firebase, Stripe, and Prodigi. Your use of those features may also be subject to their terms. We are not responsible for third-party services.
11. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or that shows or bookings will occur as planned.
12. Limitation of Liability
To the fullest extent permitted by law, PARSONS CO. LLC will not be liable for any indirect, incidental, or consequential damages, or for amounts exceeding what you paid through the App in the 12 months before the claim.
13. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the App and its users.
14. Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the latest version, and continued use of the App means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules.
